Subject of the contract: the rental of one or more bicycles with its basic equipment

Article 1 – Insurance and responsibility

For all rented bicycles, the renter is always designated as responsible for bodily and/or material damage that they may cause to third parties during the use of the rented bicycles, which they acknowledge having legal custody of. Under articles 1383 and 1384 of the Civil Code, the renter will be held responsible for damages caused to third parties. They declare that they are insured and commit to contacting their insurance company for any damages caused to third parties resulting from their use of the rented bicycle.

Article 2 – Responsibility in case of breakage

From the transfer of the bicycle to the renter, the latter becomes responsible for the bicycle, as well as the lock and all accessories. All loaned items must be returned in impeccable condition. After an inventory of the bicycle, the renter acknowledges the regulatory and compliant condition of the bicycle. The renter is the person specified in the bicycle rental contract. Essentially, only this person is authorized to use the bicycle. In case of lending the bicycle to a third party, the renter bears full responsibility for any damage that may be caused to the bicycle by the third party. The renter agrees to use the bicycle carefully, to maintain it, to pay for any damages caused to it, fines, and expenses for any traffic violations, etc. The renter also declares that they are capable of riding the rented bicycle.

Article 3 – Theft and loss

The renter is responsible in case of theft; during the rental period, the bicycle is under their full guarantee and custody. The bicycles must be protected with the provided anti-theft devices. A theft must be reported immediately so that the damage can be transmitted to the public order service / police.

Article 4 – Return of equipment

The bicycles must be returned complete and with the same equipment as when they were taken. The bicycles must be returned clean and in good condition. Any damages caused must be reported immediately. For safety reasons, the renter agrees to report to the rental company any possible impacts suffered by the helmets.

Article 5 – Deposit

When the equipment is made available by the renter, a deposit (credit card, check) of 100.00 € for city and road bikes, 300€ for exhibition bikes is required. This deposit is not cashed during the rental period. It is returned at the end of the rental after the equipment is returned, less any potential damages.

Article 6 – Cancellation

In case of cancellation by the client, no refund will be made. The services are maintained regardless of weather conditions. Only the renter reserves the right to cancel in case of force majeure or when the client’s safety is compromised.

Article 7 – Lessor’s rights

The accessories provided with the equipment must not be removed or modified by the renter. The renter generally agrees not to grant any right, real or otherwise, over the rented item to anyone, which could affect its enjoyment or limit its availability or the full ownership of the renter.

Article 8 – Rental period

The rental period must be respected as specified in the agreement of both parties. Any extension must be authorized by the renter and may incur additional fees.
